1- Introduction

Clarins U.S.A., Inc. (“Clarins”, “us”, “our” or “we”) places great importance on the protection of user’s privacy and its obligations in accordance with the legal provisions in force.

This Privacy Policy allows you to better understand what information we collect about you and what we do with that information. We urge you to read it before submitting your information.

Please note that this Privacy Policy governs information provided to Clarins and communications from Clarins, including information you provide to us on Clarins’ websites, including, but not limited to, www.clarinsusa.com, www.muglerusa.com, www.azzaro.com, (“Clarins’ Websites”) on Clarins’ blogs, on Clarins’ applications (including social media sites, such as Facebook, Instagram, Pinterest and Twitter, in promotions in which Clarins is involved, in completing customer surveys, in subscribing to our newsletters, in signing up for our loyalty programs, in participating in our sweepstakes or contests, and when provide information to us at a Clarins store, authorized point of sale or spa (brick and mortar stores) collectively all of these collection mechanisms, websites and applications and the collection of information in Clarins stores or spas, shall be referred to as “Clarins’ Sites”).

Your use of Clarins’ Sites constitutes your acceptance of this Privacy Policy and your consent to the practices it describes.

 

2 - Types of Information Collected

Personal Information We Collect From You.

Personal information or personally identifiable information means any information by which you can be identified, such as your name, address, telephone number, credit or debit card information and billing and account information, birth date, email address, profile information, and purchase history. Whether or not you provide your personally identifiable information to us is completely up to you, but if you choose not to provide the information we request you may be unable to fully enjoy Clarins’ Sites and services, make a purchase or complete a transaction.

We collect personally identifiable information from you only when you voluntarily provide us with this information. Some examples of the manner in which we collect your personally identifiable information include when you place an order through the Clarins’ Websites or in our stores, create an account on the Clarins’ Websites, make a purchase on the Clarins’ Websites, enter a sweepstakes or contest, take a survey, sign up for a loyalty program or subscribe to a newsletter, contact us with a comment or question, sign up either online or in-store to receive emails or marketing communications about our products or services, or when you visit one of our pages on a third party social networking platform such as Facebook, YouTube, Instagram, Twitter or Pinterest.

Personal Information We Collect From You.

Non-personally identifiable information can be technical information or it can be demographic information, such as your age, gender or interests. Non-personally identifiable information does not identify you personally.

Note that we may tie non-personally identifiable information with personally identifiable information, in order to provide you with better recommendations, help authenticate you or other data or information you may provide, prevent fraud, and ensure that Clarins’ Sites meet your needs. When we tie non-personally identifiable information with personally identifiable information, it is considered “personal information” or “personally identifiable information” for purposes of this Privacy Policy.

We collect personally identifiable information to serve you better and to provide you with a customized experience while using Clarins’ Sites. Here are some examples of how we use your personally identifiable information:

  • to administer Clarins’ Websites, anticipate and resolve problems with these sites, and to store contacts you enter;

We may disclose information to a third party to (a) comply with laws or respond to lawful requests and legal process, (b) to protect Clarins, and our agents, customers, and others from legal claims or actions, including claims of fraud or to enforce our agreements, policies and terms of use or (c) in the good faith belief that disclosure is needed to respond to an emergency, or protect the public safety of the public or any person.

To complete your purchase. If you choose to make a purchase on Clarins’ Sites, we may collect from you your credit card number, billing address and other information related to such purchase and we may use such collected information in order to fulfill your purchase. We may also provide such information, or other personally identifiable information provided by you, to unaffiliated third parties as necessary to complete your purchase (for example, to process your credit card).

Clarins’ Sites may also include access to social networking websites established, owned and controlled by third parties such as Facebook.com, and information may be exchanged between Clarins’ Sites and these social networking websites. If you choose to use any third- party services or access, purchase or view products or services on a third-party website, we may facilitate sharing of your personally and non-personally identifiable information with those third parties. Please note, however, that your use of any services offered or your purchase of any product offered by a third party on a third-party website shall not be solely governed by our Terms and Conditions or this Privacy Policy and we do not control the services of those third parties or how they use your information. We may be required to share your personally identifiable information in order to fulfill a service to you. For example, if you register on Clarins’ Sites, we may have to share your personal and/or non-personally identifiable information with third parties in order to provide content to you that we believe may be of interest to you.

We may also have to share your personally identifiable information if you choose to enter a sweepstakes or contest in order to fulfill the terms of that promotion. This means that we may share the information for prize fulfillment purposes. We may also share your information with the co-sponsor of that promotion or in connection with the distribution of the prize.

We may have to share your information with unaffiliated third-party service providers, agents or independent contractors who help us maintain Clarins’ Sites and provide other administrative services to us (including, but not limited to providing customer service, maintaining and analyzing data, sending customer communications on our behalf, and entry collection, winner selection and prize fulfillment for contests, sweepstakes and other promotions). We reserve the right to share non-personally identifiable information about our customers, sales, and traffic to our partners and advertisers. Please also note that we may share your non-personally identifiable information when it is tied to your personally identifiable information, in the manners described above.

 

5 - Information on Public Areas of Clarins’ Sites

Any information you submit in a public area of Clarins’ Sites – such as on a social media page, user comments, comments on Clarins’ blogs, reviews or comments on any ratings and reviews feature, questions or answer on a question and answer application or any other public forum – will not be treated as confidential and may be publicly disclosed. This applies to personally identifiable information, as well as non-personally identifiable information, so please consider your public postings before doing so. Additionally, information posted on social media pages will be subject to the terms governing those pages and websites.

 

6 - Protecting Kids’ Privacy

Clarins’ Sites are not intended for children. We do not knowingly collect personally identifiable information from children, and none of Clarins’ Sites are designed to attract children. In the event that we learn that a person under the age of 13 has provided personally identifiable information to us, we will delete such personally identifiable information.

 

7 - Protecting Your Security

Security for Clarins’ Sites is in accordance with industry standards to protect the security of your personal information both online and offline. Personally identifiable information is stored on computer servers in a controlled environment that is reasonably protected from unauthorized misuse or disclosure. We use available technology and other techniques to implement systems like firewalls, and/or encryption to secure data transfers.

Orders placed on Clarins’ Sites are encrypted using Secure Socket Layer (SSL) technology, an industry standard that is used by vendors to ensure the security of online business. It negotiates and employs the essential functions of mutual authentication, data encryption, and data integrity for secure transactions.

We take special steps to safeguard your personal information and since your password is protected only you can access your account information. We recommend that you keep your password private and always sign-off your account and close your browser when you are finished shopping.

 

8 - Opting Out

If you would like to opt out of receiving promotional emails from us, please follow the unsubscribe instructions located at the bottom of each email.

If you would like to opt out of receiving direct email, mail, mobile marketing or telephone marketing calls from us, please send your request, including your name, email address, street address, city, state, and zip code, via an email to the Customer Service. We are not responsible for notices that are not labeled or sent improperly, or do not have complete information. We will process your request within 30 days of the date we receive your request, but you may, in the meantime, received previously scheduled emails, mail or calls from us. Once you have opted out, you do not need to do so again.

 

9 - Changing, Updating or Deleting Personal Information

You can update, change or delete certain personally identifiable information (such as your email address, mailing address and payment method) on Clarins’ Websites by clicking “My Account” in the menu at the top of each page of Clarins Websites.

 

10 – Cookies and Web Tracking Techniques

We use “cookies” on Clarins’ Websites to help us analyze web traffic and evaluate and improve the content and functions of the Clarins’ Websites. A cookie is a small text file which is sent by a website, accepted by a web browser and then placed onto your computer’s hard drive. Cookies help us analyze use of our sites, and better aggregate useful information when site users provide feedback about our sites or products. We may use advertisers, third party ad networks, and other advertising companies to serve advertisements on Clarins’ Sites. Please be advised that such advertising companies may gather information about your visit to Clarins’ Sites (such as through cookies, web beacons and other technologies) to enable such advertising companies to market products or services to you, to monitor which ads have been served to your browser and which webpages you were viewing when such ads were delivered. PLEASE NOTE THAT THIS PRIVACY POLICY DOES NOT COVER THE COLLECTION AND USE OF INFORMATION BY SUCH ADVERTISING COMPANIES.

If you choose to provide us with personally identifiable information, we may transfer that information to our affiliates or to other third parties across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personally identifiable information to the United States which does not have the same data protection laws as the EU and by providing your personally identifiable information you consent to: (i) the use of your personally identifiable information for the uses identified above in accordance with this privacy policy, and (ii) the transfer of your personally identifiable information to the United States as indicated above.

 

13 - Changes to our Privacy Policy

As the content of this Privacy Policy may change from time to time, we suggest you periodically consult this Privacy Policy. We will post the revised policy here, which at that time will be effective immediately. Your continued use of Clarins’ Sites subject to this Privacy Policy will signify your acceptance of privacy policy changes.

 

14 - Assignment

In the event that all or a part of our assets are sold or acquired by another party, or in the event of a merger, you grant us the right to assign the personally identifiable and non-personally identifiable information collected via the Clarins’ Sites.

 

15 - Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of New York, excluding its conflicts-of-law principles. You expressly agree that exclusive jurisdiction for any claim or dispute with Clarins or relating in any way to your use of Clarins’ Sites lies in the state and/or federal courts sitting in the Southern District of New York, and you further agree and expressly consent to the exercise of personal jurisdiction in the state and/or federal courts sitting in the Southern District of New York in connection with any such dispute, including any claim involving Clarins, the Clarins’ Sites, our affiliates, subsidiaries, employees, contractors, officers, directors, telecommunications providers, and/or content providers.

17 - Do Not Track Disclosures

Clarins does not support Do Not Track browser settings and does not currently participate in any “Do Not Track” frameworks that would allow us to respond to signals or other mechanisms from you regarding the collection of your personally identifiable information or non- personally identifiable information.

 

18 - California Residents

Under California law, if you are a resident of California, you are entitled once per year to request and obtain certain information regarding our disclosure, if any, of you personally identifiable information to third parties for their direct marketing purposes during the immediately prior calendar year. To make such a request, please send an email to the Customer Service with your full name, email address, and postal address in your message. In response to your request, we will provide you with a notice describing the cost free means to opt-out of our sharing your personally identifiable information with third parties, if the third party will use it for their direct marketing purposes.
